Property Litigator, Temple Quay, central Bristol
Background on Role/Area:
To proactively manage a varied legal caseload to minimise loss and achieve the maximum cost-effective resolution on each case. This includes securing possession orders where applicable through the county court and identifying potential risks that may affect a sale as Mortgagee in Possession.
Reporting to: Arrears Team Leader
Key Responsibilities:
Manage and effectively organise own caseload to establish contact with borrowers who have been referred for litigation action. Ensure cases are prioritised appropriately within caseload.
Through the county court process, issue litigation proceeding on cases where the mortgage terms and conditions have not been met.
Negotiate payment arrangements with borrowers and external debt counselling agencies, supported by Suspended Possession Orders where suitable.
Manage the eviction process to ensure that properties are repossessed when applicable.
Identify cases where the Groups security is at risk and recommend appropriate action to resolve.
Instruct Solicitors to act on behalf of the Group at county court hearings.
Ensure the reputation of the Group is not adversely affected by complying with all legislative and regulatory requirements.
Have knowledge of, and adherence to departmental policy and procedure in an environment where policy may change frequently

Key Requirements:
Significant demonstrable experience within a collections / credit environment or recognised legal qualification or progressing towards the achievement of a qualification (e.g. ILEX)
Demonstrable problem solving and decision making skills
Demonstrable excellent negotiation and communication skills in order to deliver a solution that balances the needs of the customer with the best commercial decision for Bristol & West
Demonstrable knowledge of B&W / BIM mortgage systems
Demonstrable knowledge of the Data Protection Act, Money Laundering, MCOB, CML guideline to handling arrears, Internal and FSA Complaints Procedure.
Demonstrable knowledge of legal remedies for management and ultimate recovery of debt under English and Scottish Law.
